Nothing on the Platform should be interpreted as professional, legal, medical, financial, or relationship advice.

3. Eligibility

Access to TheTradeNudes is strictly limited to individuals who are at least 18 years of age or the age of majority in their jurisdiction, whichever is higher. By using the Platform, you represent and warrant that:

• You meet the minimum legal age requirement.
• You have the legal capacity to enter into a binding agreement.
• You are not prohibited by applicable law from accessing or using adult-oriented services.
• All information you provide is accurate and complete.
• You will comply with these Terms and all applicable laws.

If we believe that a user is under the required age or has provided false information regarding their eligibility, we may immediately suspend or permanently terminate the account without prior notice and report the matter to the appropriate authorities where required by law.

4. Relationship Between You and TheTradeNudes

Your use of the Platform does not create any employment, partnership, agency, joint venture, fiduciary, or other special relationship between you and TheTradeNudes. Each user acts independently and remains solely responsible for their own actions, communications, uploaded content, and interactions with other members. TheTradeNudes does not guarantee successful interactions, exchanges, friendships, relationships, transactions, or any particular experience resulting from use of the Platform.

5. Electronic Agreement

By creating an account or otherwise using the Platform, you consent to receive notices, disclosures, agreements, and other communications electronically. Electronic communications satisfy any legal requirement that such communications be provided in writing. If at any time you no longer agree to these Terms, your sole remedy is to discontinue using the Platform and close your account.

6. Accounts and Registration

To access certain features of the Platform, including uploading content, sending private messages, participating in groups, or subscribing to paid services, you must create an account. When registering an account, you agree to:

• Provide accurate, current, and complete information.
• Keep your information updated if it changes.
• Maintain only one personal account unless we expressly authorize otherwise.

7. Account Security

TheTradeNudes is not responsible for losses or damages resulting from your failure to adequately protect your account credentials.

8. Usernames and Profiles

You may choose a username and create a public profile. You may not use a username or profile that:

• Impersonates another individual or organization.
• Is intended to mislead or deceive other users.
• Infringes another person's intellectual property or personality rights.
• Is offensive, hateful, discriminatory, or otherwise violates our Community Charter.

We reserve the right to require you to change your username or profile information or to remove any content that violates these Terms.

9. Email Verification and Communications

We may require users to verify their email address before accessing certain features of the Platform. You are responsible for ensuring that your email address remains valid and accessible. Service-related communications, including security notices, moderation decisions, account updates, payment confirmations, and changes to these Terms, may be sent electronically. These communications form part of your use of the Platform. You may opt out of promotional or marketing emails where applicable, but you may not opt out of essential service communications.

10. User Responsibility

You are solely responsible for all activities conducted through your account, including:

• Content you upload.
• Messages you send.
• Groups you create or manage.
• Comments you post.
• Purchases and subscriptions.
• Interactions with other users.

You remain responsible for your account even if another person gains access because you failed to secure your credentials.

11. Suspension and Termination

We reserve the right to suspend, restrict, disable, or permanently terminate any account, with or without prior notice, where we reasonably believe that:

• These Terms or the Community Charter have been violated.
• Applicable laws have been violated.
• Fraudulent, abusive, or suspicious activity has occurred.
• The security or integrity of the Platform may be compromised.
• We receive valid legal requests from governmental authorities or courts.
• Continued access may expose TheTradeNudes or its users to legal, financial, reputational, or security risks.

Account termination may include:

• Removal of uploaded content.
• Cancellation of subscriptions where permitted by law.
• Revocation of access to purchased features.
• Permanent loss of account data, messages, and profile information, subject to applicable legal retention requirements.

We may retain certain information following account termination where required to comply with legal obligations, enforce these Terms, resolve disputes, investigate abuse, detect fraud, protect the safety of users, or satisfy legitimate business purposes.

12. Your Right to Close Your Account

You may close your account at any time through your account settings or by contacting our support team. Closing your account does not automatically cancel any active paid subscription unless expressly stated during the cancellation process. Certain information may continue to be retained after account closure where required by applicable law or as described in our Privacy Policy. Provisions of these Terms that are intended to survive termination—including, but not limited to, intellectual property rights, licences granted by users, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law—will continue to apply after your account has been closed.

13. User Content

TheTradeNudes allows users to upload, publish, transmit, share, and otherwise make available photographs, videos, text, comments, profile information, messages, and other materials ("User Content"). You retain ownership of any intellectual property rights you hold in your User Content. Nothing in these Terms transfers ownership of your content to TheTradeNudes. However, by uploading or submitting User Content to the Platform, you grant TheTradeNudes a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, process, display, transmit, distribute, and otherwise use your User Content solely for the purpose of operating, maintaining, securing, improving, moderating, promoting, and providing the Platform and its services. This licence remains in effect until your User Content is removed from the Platform, except to the extent that copies have been retained for backup, security, legal compliance, dispute resolution, or other legitimate business purposes.

14. Your Representations and Warranties

By uploading or sharing any User Content, you represent and warrant that:

• You own the content or have all necessary legal rights and permissions to upload and share it.
• Every identifiable person appearing in the content is at least 18 years of age or the legal age of majority applicable to them, whichever is higher.
• Every identifiable person appearing in the content knowingly and voluntarily consented to the creation of the content and to its upload and distribution through TheTradeNudes.
• The content does not infringe any copyright, trademark, privacy, publicity, contractual, or other legal rights of any third party.
• The content complies with these Terms, the Community Charter, and all applicable laws.
• Any information you provide regarding the content is accurate, complete, and not misleading.

You further agree to maintain any records, releases, consents, or other documentation necessary to substantiate the representations and warranties made under these Terms. Upon our reasonable request, you agree to promptly provide such documentation for the purpose of verifying ownership, age, identity, consent, or compliance with applicable laws. Failure to maintain or provide such documentation may result in the removal of content, suspension or termination of your account, or any other action permitted under these Terms. You acknowledge that you—not TheTradeNudes—are solely responsible for the legality, ownership, authenticity, accuracy, and consequences of the User Content you upload.

15. Consent Requirements

Consent is a fundamental requirement of the Platform. You must not upload, share, transmit, request, trade, or otherwise distribute any intimate or sexually explicit content unless every identifiable individual appearing in that content has knowingly and voluntarily consented to both:

1. the creation of the content; and

2. its distribution through TheTradeNudes.

Consent must exist before any content is uploaded. If consent is withdrawn, disputed, or cannot reasonably be demonstrated, we may remove the content immediately and take any additional action we consider appropriate, including suspending or terminating the responsible account. We reserve the right to request information or documentation reasonably necessary to investigate reports concerning consent, ownership, or the legality of uploaded content.

15A. Age Verification and Record-Keeping Compliance

TheTradeNudes is intended exclusively for consenting adults. Protecting minors and preventing the distribution of unlawful content are among our highest priorities. By uploading any User Content to the Platform, you represent and warrant that every identifiable person appearing in the content is at least 18 years of age, or the legal age of majority in the applicable jurisdiction, whichever is higher. TheTradeNudes reserves the right, at any time and at its sole discretion, to request information or documentation reasonably necessary to verify:

• The age of any individual depicted in uploaded content.
• The identity of the user uploading the content.
• Ownership or lawful possession of the content.
• The existence of valid consent from every identifiable person appearing in the content.
• Compliance with these Terms, our Community Charter, and applicable laws.

Acceptable documentation may include government-issued identification, written consent forms, model releases, or other information that we reasonably determine is sufficient to verify compliance. Failure or refusal to provide requested documentation within the time specified by TheTradeNudes may result in one or more of the following actions:

• Removal of the relevant content.
• Restriction of Platform features.
• Temporary suspension of the account.
• Permanent termination of the account.
• Reporting the matter to appropriate law enforcement or regulatory authorities where required by law or reasonably necessary to protect the Platform or its users.

TheTradeNudes reserves the right to retain verification records, correspondence, and related documentation for as long as reasonably necessary to comply with applicable legal obligations, investigate complaints, resolve disputes, prevent fraud, enforce these Terms, or protect the rights, safety, and security of the Platform and its users. Nothing in this section creates an obligation for TheTradeNudes to verify the age, identity, ownership, or consent relating to every item of User Content. Users remain solely responsible for ensuring that all content they upload fully complies with these Terms and all applicable laws.

16. Prohibited User Content

In addition to the restrictions contained in the Community Charter, you agree not to upload, distribute, request, or facilitate any content that:

• Depicts or involves anyone under the age of 18.
• Was created or distributed without the consent of every identifiable person involved.
• Constitutes revenge porn or non-consensual intimate imagery.
• Has been obtained through hacking, theft, hidden cameras, spyware, coercion, blackmail, or other unlawful means.
• Contains deepfakes, digitally manipulated intimate images intended to deceive, or AI-generated content falsely depicting identifiable individuals.
• Promotes or facilitates exploitation, abuse, trafficking, or sexual violence.
• Violates any applicable law or court order.
• Infringes another person's copyright, trademark, privacy, publicity, or other legal rights.

TheTradeNudes may remove any content that we reasonably believe violates these Terms, even if no formal complaint has been received.

17. Content Moderation

TheTradeNudes is not obligated to monitor every item of User Content or every interaction occurring on the Platform. Nevertheless, we reserve the right, at our sole discretion and without prior notice, to:

• Review User Content.
• Remove or restrict access to any content.
• Edit or remove profile information.
• Disable messaging privileges.
• Restrict access to groups or other features.
• Suspend or permanently terminate user accounts.
• Cooperate with law enforcement authorities and regulatory agencies where required or appropriate.

Moderation decisions are made to protect the Platform, its users, and our legal obligations. We are under no obligation to restore removed content or explain every moderation decision.

18. Reporting Illegal or Infringing Content

Users are encouraged to report content they believe:

• Violates these Terms.
• Violates the Community Charter.
• Infringes intellectual property rights.
• Was uploaded without consent.
• Is otherwise unlawful or abusive.

Reports will be reviewed as promptly as reasonably practicable. Submitting knowingly false or malicious reports may itself constitute a violation of these Terms and may result in suspension or termination of your account.

19. No Duty to Preserve Content

TheTradeNudes does not guarantee that User Content will remain available. We may remove, archive, restrict access to, or permanently delete User Content at any time, including where required for moderation, legal compliance, security, technical maintenance, account termination, or operational reasons. Users are solely responsible for maintaining their own copies of any content they upload. TheTradeNudes is not responsible for the loss, deletion, corruption, or unavailability of User Content.

19A. No Expectation of Absolute Confidentiality

TheTradeNudes encourages all users to respect the privacy of others and strictly prohibits the unauthorized copying, redistribution, publication, or sharing of another person's content without their permission. However, by choosing to upload, send, or otherwise share content through the Platform, you acknowledge and accept that no online platform can guarantee absolute confidentiality or prevent all unauthorized conduct by third parties. While TheTradeNudes implements moderation measures, security features, and enforcement procedures designed to promote a safe and respectful community, we cannot guarantee that users will always comply with these Terms, the Community Charter, or applicable laws. Accordingly, you acknowledge that any content you voluntarily share through the Platform may be copied, captured, recorded, redistributed, or otherwise misused by other users or third parties despite our policies and enforcement efforts. You are solely responsible for deciding whether to share content and for assessing the risks associated with doing so. We encourage users to exercise caution and to avoid sharing any content they would not be comfortable having viewed or redistributed by others. Except where liability cannot be excluded under applicable law, TheTradeNudes, its owners, operators, employees, moderators, contractors, and affiliates shall not be liable for the unauthorized copying, redistribution, publication, disclosure, or misuse of User Content by other users or third parties. Nothing in this section limits TheTradeNudes' right to investigate reports, remove content, suspend accounts, or cooperate with law enforcement authorities where appropriate.

20. Acceptable Use

You agree to use TheTradeNudes only for lawful purposes and in accordance with these Terms, our Community Charter, and all applicable laws. You agree not to:

• Use the Platform for any unlawful, fraudulent, or deceptive purpose.
• Circumvent, disable, or interfere with the Platform's security features.
• Attempt to gain unauthorized access to any account, server, database, or network.
• Use bots, scripts, scrapers, crawlers, or other automated means to access or collect data from the Platform without our prior written permission.
• Reverse engineer, decompile, or otherwise attempt to extract the source code of the Platform.
• Upload viruses, malware, ransomware, spyware, or other malicious code.
• Interfere with the normal operation, performance, or security of the Platform.
• Collect or harvest personal information about other users without their consent.
• Use the Platform to facilitate or promote illegal activities.
• Encourage or assist others in violating these Terms.

We reserve the right to investigate suspected violations and to take any action we consider appropriate, including restricting access, suspending accounts, removing content, or notifying law enforcement authorities.

21. Private Messaging

The Platform allows members to communicate through private messaging. Users are solely responsible for the content of their communications and for any consequences arising from those communications. TheTradeNudes does not routinely monitor private messages. However, we reserve the right to access, review, preserve, or disclose private communications where reasonably necessary to:

• Investigate reports of abuse or violations of these Terms.
• Protect the safety of users.
• Detect fraud, spam, scams, or other malicious activity.
• Comply with applicable laws, court orders, or lawful requests from public authorities.
• Protect the rights, property, or security of TheTradeNudes or others.

Users should never assume that communications made through the Platform are completely private or immune from legal disclosure.

22. Groups and Community Features

Users may create, join, manage, and participate in groups, discussions, forums, or other community features made available on the Platform. Group owners and moderators may establish additional rules for their communities, provided those rules do not conflict with these Terms, the Community Charter, or applicable law. TheTradeNudes reserves the right to remove groups, restrict community features, replace moderators, or remove group administrators where necessary to protect users or maintain the integrity of the Platform.

23. Paid Features and Subscriptions

Certain features of the Platform may require payment, including subscriptions or other premium services. The availability, pricing, duration, and features of paid services may change at any time. By purchasing a subscription or other paid feature, you authorize us or our third-party payment processor to charge the applicable fees using your selected payment method. Unless otherwise stated during the purchase process, subscriptions automatically renew at the end of each billing period until cancelled. You are responsible for cancelling your subscription before the renewal date if you do not wish to continue.

24. Payments

Payments are processed by independent third-party payment providers. TheTradeNudes does not store complete payment card information and is not responsible for errors, delays, interruptions, or security incidents involving third-party payment processors. You agree to provide accurate billing information and to maintain a valid payment method while using paid services. Failure to successfully process payment may result in suspension or termination of access to paid features.

25. Refunds

Except where required by applicable law or expressly stated otherwise, all purchases are final and non-refundable. No refunds will be provided for:

• Partial subscription periods.
• Failure to use the Platform.
• Account suspension or termination resulting from your violation of these Terms.
• Dissatisfaction with user-generated content or interactions between users.
• Temporary service interruptions, maintenance, or technical issues that do not materially prevent access to the purchased service.

Nothing in this section limits any non-waivable rights you may have under applicable consumer protection laws.

26. User Interactions

You understand that interactions with other users occur solely between the participating members. TheTradeNudes is not responsible for:

• Statements made by users.
• Promises or agreements between users.
• Financial transactions between users.
• Content exchanged between users.
• Meetings or encounters arranged through the Platform.
• Disputes arising between members.

You assume all risks associated with interacting with other users, whether online or offline. We encourage users to exercise caution, verify identities where appropriate, and report suspicious or unlawful conduct.

27. No Guarantees

TheTradeNudes does not guarantee:

• That you will receive messages or responses from other users.
• That any particular user is genuine, truthful, or acting in good faith.
• That content available on the Platform is accurate or complete.
• That users will comply with these Terms.
• That any paid feature will produce a particular outcome.

Any reliance you place on user-generated content or interactions is at your own risk.

28. Enforcement

Violations of this section may result in one or more enforcement actions, including:

• Warnings.
• Removal of content.
• Restriction of Platform features.
• Suspension of messaging privileges.
• Permanent account termination.
• Cancellation of subscriptions without refund where permitted by law.
• Reporting to law enforcement or regulatory authorities where appropriate.

The remedies described in these Terms are cumulative and do not limit any other rights or remedies available to TheTradeNudes under applicable law.

29. Intellectual Property

Unless otherwise indicated, TheTradeNudes, including its name, logos, trademarks, branding, software, design, graphics, layout, text, databases, source code, and other content made available by TheTradeNudes (excluding User Content), are owned by or licensed to TheTradeNudes and are protected by applicable copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights in the Platform or its intellectual property to you. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, lawful, and non-commercial use.

30. Restrictions on Use

Unless expressly authorized in writing by TheTradeNudes, you may not:

• Copy, reproduce, distribute, republish, or publicly display any part of the Platform.
• Modify, adapt, translate, or create derivative works from the Platform.
• Sell, licence, rent, lease, or commercially exploit any portion of the Platform.
• Remove or alter copyright, trademark, or proprietary notices.
• Mirror or frame the Platform on another website.
• Use our trademarks, logos, or branding in a manner that suggests sponsorship, endorsement, or affiliation without our prior written consent.

31. Ownership of User Content

Users retain ownership of the intellectual property rights they hold in the content they upload. However, by submitting User Content to the Platform, you confirm that you have the legal authority to grant the licence described in these Terms and that doing so does not violate the rights of any third party. Nothing in these Terms prevents you from removing your own content or otherwise exercising rights you may have under applicable law, subject to any licences already granted and our rights to retain copies for legal, security, backup, or operational purposes.

32. Copyright Infringement

TheTradeNudes respects the intellectual property rights of others. If you believe that content available on the Platform infringes your copyright or other intellectual property rights, you should submit a written notice containing:

• Your name and contact information.
• A description of the copyrighted work or other protected material.
• The location (URL or other identifying information) of the allegedly infringing content.
• A statement explaining the basis of your ownership or authority.
• A statement that you have a good-faith belief that the use is unauthorized.
• A statement that the information provided is accurate and, where applicable, that you are the copyright owner or authorized to act on behalf of the owner.

We may request additional information before taking action on any complaint. Knowingly submitting false or misleading infringement claims may expose you to legal liability.

33. Removal of Content

Upon receiving a valid complaint or otherwise becoming aware of potentially unlawful or infringing content, TheTradeNudes may, at its sole discretion:

• Remove or disable access to the content.
• Restrict access to the relevant account.
• Request additional information from the uploader.
• Preserve evidence for investigative or legal purposes.
• Notify law enforcement or other competent authorities where appropriate.

Removal of content does not constitute an admission that any law or legal right has been violated.

34. Repeat Infringer Policy

We reserve the right to suspend or permanently terminate accounts belonging to users who repeatedly infringe copyrights, violate privacy rights, upload non-consensual content, impersonate others, or otherwise violate intellectual property laws. The determination of whether a user is a repeat infringer is made solely by TheTradeNudes based on the information reasonably available to us.

35. Reporting Non-Consensual Intimate Content

If you believe intimate content depicting you has been uploaded without your consent, you may contact us to request its review and removal. We take reports of non-consensual intimate imagery seriously and may remove content, restrict accounts, preserve evidence, and cooperate with law enforcement authorities where appropriate. We may require sufficient information to verify the identity of the reporting individual and assess the validity of the request before taking action.

36. Feedback

If you voluntarily provide suggestions, comments, ideas, feature requests, bug reports, or other feedback regarding the Platform ("Feedback"), you grant TheTradeNudes a perpetual, irrevocable, worldwide, royalty-free licence to use, modify, publish, commercialize, and incorporate that Feedback into the Platform without compensation or acknowledgement. You acknowledge that providing Feedback does not create any obligation for TheTradeNudes to implement your suggestions.

37. Reservation of Rights

All rights not expressly granted under these Terms are reserved by TheTradeNudes. No licence or right is granted by implication, estoppel, or otherwise except as expressly provided in these Terms.

38. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis, without any warranties, representations, or guarantees of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, TheTradeNudes disclaims all warranties, including but not limited to:

• Merchantability.
• Fitness for a particular purpose.
• Non-infringement.
• Accuracy, reliability, or completeness of information.
• Quiet enjoyment.
• Continuous availability or uninterrupted access.

We do not warrant that:

• The Platform will operate without interruption or error.
• The Platform will always be secure or free from viruses or malicious software.
• Any defects or errors will be corrected.
• User-generated content is accurate, authentic, lawful, or reliable.
• Any user is who they claim to be.
• The Platform will meet your expectations or produce any particular outcome.

Your use of the Platform is entirely at your own risk.

39. User Assumption of Risk

You acknowledge that using an online platform that facilitates interactions between adults involves inherent risks. These risks may include, without limitation:

• Fraud and scams.
• Catfishing or impersonation.
• Harassment or offensive communications.
• Unauthorized redistribution of content.
• Privacy breaches.
• Identity theft.
• Financial loss.
• Emotional distress.
• Criminal or unlawful conduct by third parties.

Although TheTradeNudes actively moderates the Platform and enforces its policies, we cannot eliminate these risks or guarantee the conduct of any user. You voluntarily assume all risks associated with your use of the Platform and your interactions with other users, whether they occur online or offline.

40. Limitation of Liability

To the fullest extent permitted by applicable law, TheTradeNudes, its owners, directors, officers, employees, contractors, moderators, affiliates, licensors, partners, successors, and assigns shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages arising out of or relating to:

• Your use of or inability to use the Platform.
• User-generated content.
• Communications between users.
• Content exchanged through private messages.
• Groups or community discussions.
• Unauthorized access to your account.
• Loss, theft, corruption, or deletion of data.
• Security breaches caused by third parties.
• Service interruptions or downtime.
• Payment processor failures.
• Decisions made by moderators.
• Removal of content or suspension of accounts.
• Any interactions or transactions between users.
• Any reliance placed on content published by users.

This limitation applies regardless of the legal theory asserted, including contract, negligence, tort, strict liability, statutory liability, or otherwise, even if TheTradeNudes has been advised of the possibility of such damages. Where applicable law does not permit the exclusion of certain liabilities, our liability will be limited to the maximum extent permitted by law.

41. Indemnification

You agree to defend, indemnify, and hold harmless TheTradeNudes, its owners, officers, employees, moderators, contractors, affiliates, successors, and assigns from and against any claims, demands, proceedings, investigations, liabilities, damages, judgments, settlements, fines, penalties, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the Platform.
• Your User Content.
• Your communications with other users.
• Your violation of these Terms.
• Your violation of the Community Charter.
• Your violation of any applicable law.
• Your infringement of another person's intellectual property, privacy, publicity, or other legal rights.
• Any false representations you make regarding ownership, consent, or legality of uploaded content.

This obligation survives the termination of your account and your use of the Platform.

42. Third-Party Services
